Agency Terms & Conditions of AvanderNet s.r.o.
These Terms & Conditions of AvanderNet s.r.o. define the conditions for the arrangement of contracts for holiday accommodation between customers and landlords/tour operators (hereinafter referred to as "Service Providers").
AvanderNet acts as a representative for the Service Providers in the initiation and conclusion of contracts for holiday accommodation with customers.
These Terms & Conditions of AvanderNet do not replace the relevant provisions of the Terms & Conditions of the respective Service Providers (hereinafter referred to as "TCSP").
1. Conclusion of contracts
1.1. Telephone, electronic or written booking request made by the customer constitutes a binding offer to enter into a travel agreement with the Service Provider represented by AvanderNet. AvanderNet reserves the right to accept such offer. A binding contract is deemed concluded only when AvanderNet or the Service Provider has confirmed the booking in writing, by phone or by email. The customer bears in mind that if the booking is cancelled subsequently, the customer may incur a cancellation fee.
1.2. By completion of the booking, the customer accepts the Terms and Conditions of the respective Service Provider as well as the Terms & Conditions of AvanderNet. The TCSP can be found as a link in the booking form of each holiday accommodation. Before completion of the booking, the customer will be referred to the TCSP and will be asked to express consent with the wording thereof. AvanderNet advises customers to print a copy of the TCSP for their record.
1.3. Following successful completion of the booking, the customer will receive an email with preliminary booking confirmation from AvanderNet as the representative. The customer will receive all other information subsequently via email from the respective Service Provider.
1.4. The customer is obliged to promptly check the accuracy of the information specified in the booking confirmation. If case of an error or a discrepancy, the customer shall be required to inform the Service Provider and AvanderNet. The customer must notify the Service Provider and AvanderNet without undue delay.
1.5. During completion of the booking form, the customer is required to specify the number of people (including children) as well as whether they intend to bring pets with them. Some holiday accommodations only allow pets based on approval of the owner.
2. Payment / Travel documents
Depending on the Service Provider, the rent is payable either via bank transfer or debit/credit card. The detailed payment terms are to be found in the booking confirmation of the respective Service Provider. For certain types of payments such as payment by debit or credit card, AvanderNet and the Service Providers reserve the right to charge additional fees. Please note that the Service Provider will not be liable for any bank fees (domestic or international) incurred from the transfer of rent. The payment methods are listed in the description of the respective holiday accommodation.
3. Notice of passport, visa and health requirements
3.1. The customer is responsible for ensuring compliance with valid domestic and foreign entry and exit regulations, health regulations and passport and visa requirements.
3.2. Information regarding safety, conditions for entry to particular countries, health regulations, visas, etc. can be found on the websites of the respective Ministry of Foreign Affairs.
4. Withdrawal / Rebooking
4.1. The customer may withdraw from the agency agreement and cancel the booking at any time before the start of the rental period (cancellation). The relevant date is the date of receipt of the notification of cancellation by the respective Service Provider. It is strongly recommended that the customer provide this notice of cancellation in writing or via email. Depending on the time of cancellation and the Terms and Conditions of the respective Service Provider, cancellation fees may be incurred.
4.2. Changes to a confirmed booking are possible, but additional fees may incur. Certain Service Providers charge flat fees for changes to confirmed bookings. In exceptional cases, changes to a confirmed booking may be possible only via cancellation and then a new booking being made. In such case, the customer may incur a cancellation fee.
AvanderNet recommends that customers arrange travel health insurance even when travelling to other European countries, since even minor accidents can result in high costs, which may not be covered unconditionally by the statutory health insurance. AvanderNet also recommends that customers arrange travel cancellation insurance.
6. Data protection
AvanderNet collects and processes personal data, which is necessary for providing of services. AvanderNet ensures the security of personal data and their protection against unauthorised access and takes necessary measures to protect personal data in accordance with the provisions of the Act No. 101/2000 Coll., on personal data protection.
7. Final provisions
7.1. Should any of the provisions hereof become or be found to be invalid, ineffective or unenforceable, this shall have no effect on the validity, effectiveness and enforceability of the rest of the provisions hereof.
7.2. In the event of a breach hereof or if reasonable suspicion arises that a breach hereof has occurred, particularly if the customer states untruthful or obviously false information when making a booking, AvanderNet shall be entitled at any time to exclude such customer from the use of this website.
7.3. These Terms & Conditions are governed by British law.
